Agreement to Terms

By accessing or using FreshStops (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

Description of Service

FreshStops is a platform that connects customers with local roadside vendors, farm stands, and direct-to-consumer sellers. We provide:

• A searchable directory of local vendors and stands with map-based discovery
• Information about products, pricing, and availability
• Tools to facilitate payment through third-party services
• Customer features including favorites, collections, reviews, alerts, and event itineraries
• A listing of farmers markets, festivals, and other local events

FreshStops is a discovery and connection platform. We do not sell products, process payments, or guarantee the quality, safety, legality, or availability of any goods or services listed by vendors.

FreshStops is intended for lawful, direct-to-consumer listings commonly associated with roadside stands, farm stands, local food producers, small-scale growers, makers, and similar local vendors. We reserve the right, in our sole discretion, to determine which categories of goods, services, and vendor types are appropriate for the Platform.

User Accounts

Vendors

Vendor accounts are free to create and maintain. There are no subscription fees, listing fees, transaction fees, or hidden charges of any kind.

As a vendor, you agree to:

• Provide accurate and current business, stand, and product information
• Keep your stand information, hours, and product listings up to date
• Comply with all applicable local, state, and federal laws, regulations, licensing requirements, and food safety rules
• Handle customer transactions honestly and fairly
• Respond to customer reviews and inquiries in good faith
• List only goods and services that are appropriate for the Platform and permitted under these Terms

Prohibited Products and Listings

FreshStops is not a marketplace for all lawful commerce. Certain products, services, and listing categories are not permitted on the Platform, even if they may be lawful in some jurisdictions.

Vendors may not list, advertise, offer, promote, or otherwise use the Platform in connection with:

• Firearms, ammunition, weapon components, explosives, or fireworks
• Live animals, livestock, or animal sales of any kind
• Motor vehicles, titled vehicles, or regulated automotive parts
• Scrap metal, salvage materials, junk removal, or similar industrial or salvage-oriented listings
• Alcohol, tobacco, nicotine products, cannabis, controlled substances, or drug paraphernalia
• Hazardous materials, flammable substances, chemicals, pesticides, or items requiring special handling or transport controls
• Stolen goods, counterfeit goods, recalled goods, or unlawfully acquired property
• Any item whose sale, transfer, possession, ownership, or use is prohibited or restricted by law
• Any item whose sale, transfer, possession, ownership, or use requires a license, permit, registration, background check, or similar governmental approval
• Any product or service that FreshStops determines, in its sole discretion, is inconsistent with the purpose of the Platform

We may remove any listing, restrict account features, or suspend or terminate any account at our sole discretion if we believe a listing is prohibited, inappropriate, misleading, unsafe, unlawful, or inconsistent with the purpose of the Platform.

Customers

Customer accounts may be created through full registration or our streamlined signup flow, which creates an account using your email address.

As a customer, you agree to:

• Use the Platform for legitimate purposes
• Provide honest reviews and feedback that reflect genuine experiences
• Complete payment for items you purchase from stands
• Respect vendors, their property, and other customers
• Use your own judgment before visiting a stand, attending an event, or purchasing any item listed on the Platform

Payment Terms

Important: FreshStops does not process, handle, hold, or intermediate payments in any way. All transactions occur directly between customers and vendors through one of the following methods:

• Cash
• Third-party payment services such as Venmo, PayPal, Cash App, Zelle, or Apple Cash

Each transaction is subject to the terms and conditions of the chosen payment service. FreshStops is not responsible for payment disputes, failed transactions, chargebacks, refunds, non-delivery, or any issues arising from the use of third-party payment services. Contact the payment provider or vendor directly for any payment-related issues.

Honor System

Many roadside stands operate on an honor system, where products are available for self-service purchase. Customers using such stands are expected to:

• Pay the listed price for all items taken
• Leave payment in designated areas or complete digital payments promptly
• Report any issues to the vendor

Failure to pay for items taken from honor-system stands is theft and may be subject to legal consequences.

Reviews and User Content

Customers may submit reviews and ratings for stands and products. Reviews are subject to moderation.

You agree that your reviews and other content:

• Reflect genuine personal experiences
• Do not contain false, misleading, or defamatory statements
• Do not include personal information about vendors beyond what is publicly listed
• Do not contain offensive, abusive, discriminatory, or harassing language
• Do not promote illegal activity or prohibited products
• Do not infringe the rights of any third party

We reserve the right, but not the obligation, to review, moderate, remove, or restrict any review or user content for any reason, including suspected violations of these Terms.

Collections and Shared Content

Customers may create collections of stands. Collections marked as "public" can be viewed by anyone with the share link.

You are responsible for the content you include in public collections, including names, descriptions, and notes. Do not include private, confidential, or sensitive information in public collections.

FreshStops may remove or restrict shared content that violates these Terms or creates legal, privacy, safety, or reputational concerns.

Content and Conduct

You agree not to:

• Post false, misleading, or inaccurate information
• Harass, threaten, stalk, or abuse vendors or other users
• Attempt to defraud, deceive, or impersonate vendors, customers, or FreshStops
• Use the Platform for illegal purposes or in violation of applicable law
• Offer, promote, or facilitate prohibited products or listings
• Scrape, crawl, copy, harvest, or collect data from the Platform without written permission
• Interfere with, disrupt, damage, or impair the Platform's operation or security
• Attempt to gain unauthorized access to any part of the Platform or related systems
• Create multiple accounts to circumvent restrictions, enforcement actions, or moderation decisions

Intellectual Property

The FreshStops name, logo, branding, and Platform design are the property of FreshStops.

Vendors and users retain ownership of the content they submit, including business information, product descriptions, images, reviews, and collection content, as applicable. By uploading or submitting content to the Platform, you grant FreshStops a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and use that content as necessary to operate, improve, promote, and provide the Platform.

You represent that you have the rights necessary to submit any content you post to the Platform.

Limitation of Liability

FreshStops is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

To the fullest extent permitted by law, FreshStops is not liable for:

• The quality, safety, legality, or accuracy of vendor listings, products, services, or event information
• Payment disputes or transaction issues between customers and vendors
• Theft, damage, injury, illness, loss, or harm occurring at vendor locations or in connection with listed products or services
• The accuracy of location data, hours, distances, product availability, or listing details shown on the Platform
• Any indirect, incidental, special, consequential, exemplary, or punitive damages
• Any loss of profits, revenues, goodwill, data, or business opportunities arising from or related to your use of the Platform

Indemnification

You agree to indemnify, defend, and hold harmless FreshStops and its owners, operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use of the Platform
• Your content, listings, or reviews
• Your violation of these Terms
• Your violation of any law, regulation, or third-party right
• Any dispute between you and another user, vendor, customer, or third party

Termination

We may suspend, restrict, remove content from, or terminate accounts at any time and at our sole discretion, with or without notice, if we believe a user has violated these Terms, created risk for other users, exposed FreshStops to legal or reputational harm, or used the Platform in a manner inconsistent with its intended purpose.

Vendors may close their accounts at any time through their account settings, which will archive their data and remove their listings from public display. Customers may delete their accounts through their account settings.

Termination or suspension does not limit any other rights or remedies available to FreshStops.

Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page or by other reasonable means. Continued use of the Platform after any changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the United States and the applicable laws of the state in which FreshStops is operated, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved in accordance with applicable law.
